My husband and I purchased a house for renovation over 5 years ago and the mortgage is in joint names, we seperated nearly 2 years ago (we're not divorced yet) and I left the house with our 2 children because the house is still barely habitable and we moved in with rent free with my parents, my ex has been living there on his own since and has been paying the mortgage on his own from the point of me leaving, he has now met a new partner and they are wanting for her and her children to move into the house with him, he wants to re-mortgage and buy me out which I am fine with but I really don't think this is an option because he has bad credit history and I don't think he would be able to do this.
I am happy to sell the house so that we can split any equity left and move on with our lives but it seems he would rather keep the property if possible in order to renovate it with his new partner.
What position am I in if she moves into the house that I own half of?, does she have any legal right once she lives there? if I find a buyer for the property am I able to make her leave? Can I actually do anything to stop someone moving into a house I half own?
Any advice would be appreciated.

Hi Becky,

You need to speak to a solicitor here, and as far as I am aware there aren't any that frequent this board.

As a mortgage broker I could advise on the obtaining of a mortgage for your partner, but not on the legal issues you have mentioned.

Phone a solicitor and ask them where you stand.
